Immigration benefit that allows certain foreign nationals who fear persecution to remain lawfully in the U.S. indefinitely. People who are granted asylum may apply for lawful permanent residence (a green card) one year after being granted asylum.

My ancestors weren't seeking asylum. Asylum is legal but illegal entry is not. The asylum seekers have a way to legally present themselves at the border. If they bypass the border with their children, thinking their children will protect them, they put their children at risk. Everyone on BIA sees you are the lawless one Ron. Judge Dolly Gee of the Central District of California formally refused the administration’s request to modify the Flores court settlement, which governs the treatment of children in immigration custody. The Flores agreement was the court ruling that the administration had pointed to for its policy of family separation — because it couldn’t keep children detained longer than 20 days, per Flores, it had to split children from their parents while the parents were in detention.

Gee rejected the administration’s request to allow Immigration and Customs Enforcement (ICE) to keep migrant families in detention facilities for as long as it took to process their cases (a process which, for asylum seekers, can take months or longer).

There are 103 children under age 5 covered by the court case. Of the 103 children:

57 children have been reunified as of 7 a.m. EST on July 12.
46 children were acknowledged by the court to be ineligible for reunification or determined by HHS, DHS, and DOJ to be ineligible under court-approved criteria. Of these 46:
22 children have been found ineligible due to safety concerns posed by the adults in question:
1 adult is being treated for a communicable disease.
1 adult planned to house the child with an adult charged with s*xually abusing a child.
1 adult was alleged to have abused the child.
1 adult had a falsified birth certificate (parentage is being examined).
7 adults were determined not to be a parent.
11 adults have a serious criminal history (charges or convictions for child cruelty, kidnapping, murder, human smuggling, domestic violence, etc.).
24 children are not currently eligible for reunification due to circumstances of the adults in question:
12 adults have been deported and are being contacted.
9 adults are in custody of the U.S. Marshals Service for other offenses.
2 adults are in custody of state jails for other offenses.
1 adult’s location has been unknown for over a year

I’ve been working with are the ones that are actually being prosecuted for criminal entry, which is a pretty new thing for our country—to take first-time asylum seekers who are here seeking safe refuge, to turn around and charge them with a criminal offense. Those parents are finding themselves in adult detention centers and in a process known as expedited removal, where many are being deported. And their children, on the other hand, are put in a completely different legal structure. They are categorized as unaccompanied children and thus are being put in place in a federal agency not with the Department of Homeland Security but with Health and Human Services. And Health and Human Services has this complicated structure in place where they’re not viewed as a long-term foster care system—that’s for very limited numbers—but their general mandate is to safeguard these children in temporary shelters and then find family members with whom they can be placed. So they start with parents, and then they go to grandparents, and then they go to other immediate family members, and then they go to acquaintances, people who’ve known the children, and they’re in that system, but they can’t be released to their parents because their parents are behind bars. And we may see more parents that get out of jail because they pass a “credible fear” interview, which is the screening done by the asylum office to see who should be deported quickly, within days or weeks of arrival, and who should stay here and have an opportunity to present their asylum case before an immigration judge of the Department of Justice. So we have a lot of individuals who are in that credible fear process right now, but in Houston, once you have a credible fear interview (which will sometimes take two to three weeks to even set up), those results aren’t coming out for four to six weeks. Meanwhile, these parents are just kind of languishing in these detention centers because of the zero-tolerance policy. There’s no individual adjudication of whether the parents should be put on some form of alternative detention program so that they can be in a position to be reunited with their kid.
