The public should applaud the Trump administration and the Commerce Department for reinstating a citizenship question on the 2020 census form. Despite the howls of hysterical protests coming from political partisans, this is long overdue and in accord with historical practice.

The Constitution requires an “actual Enumeration” every decade, and the priority of the census, as outlined by Karen Dunn Kelley, the under secretary for Economic Affairs at the Commerce Department in her March 26 announcement, is “obtaining complete and accurate data.” That data is used for everything from enforcement of the Voting Rights Act to the distribution of federal funding.

We have also been in the midst of a contentious debate for more than a decade about immigration. To have an informed debate, shouldn’t we have accurate information about the citizen/noncitizen population of the country? In fact, even the United Nations recommends that its member countries ask a citizenship question on their census surveys, and countries ranging from Australia to Germany to Indonesia all ask this question. Only in the U.S. is this considered at all controversial — and it shouldn’t be.

Former Attorney General Eric Holder and California Attorney General Xavier Becerra, who claim this is “irresponsible” and “unconstitutional,” show their lack of understanding of both the history of the census and the Constitution. President Thomas Jefferson first proposed a citizenship question in 1800. It was added to the census in 1820 with a question that asked for the number of “foreigners not naturalized” in the household. As Kelley points out, prior decennial census surveys “consistently asked citizenship questions up until 1950.”

WASHINGTON — The Supreme Court ruled Thursday that the Trump administration cannot include a question about citizenship on the 2020 census form that goes to every U.S. household, giving a win to mostly Democratic populous states that said the question would discourage legal and illegal immigrants from responding and make the population count less accurate.
The court was deeply fractured on the issue, but on the section that essentially eliminated the citizenship question, the vote was 5-4, with Chief Justice John Roberts joining the four-member liberal wing of the court.

The court's majority said the government has the right to ask a citizenship question, but that it needs to properly justify changing the long-standing practice of the Census Bureau. The Trump administration's justification was "contrived," Roberts wrote, and did not appear to be the genuine reason for the change, possibly implying that the real reason was political.

The census data needs to be available and accurate for the next TEN YEARS.

[the] Census Bureau had determined based on experience that administrative records to which it had access would enable it to determine citizenship status for approximately 90 percent of the population. At that point, the benefits of using administrative records were limited because the Department had not yet been able to access several additional important sets of records with critical information on citizenship. Under the Secretary of Commerce’s decision memorandum directing the Census Bureau “to further enhance its administrative record data sets” and “to obtain as many additional Federal and state administrative records as possible,” the Department has sought access to several such sets of records maintained by other agencies, but it remains in negotiations to secure access. The executive action I am taking today will ensure that the Department will have access to all available records in time for use in conjunction with the census.

Therefore, to eliminate delays and uncertainty, and to resolve any doubt about the duty of agencies to share data promptly with the Department, I am hereby ordering all agencies to share information requested by the Department to the maximum extent permissible under law.

I am also ordering the establishment of an interagency working group to improve access to administrative records, with a goal of making available to the Department administrative records showing citizenship data for 100 percent of the population. And I am ordering the Secretary of Commerce to consider mechanisms for ensuring that the Department’s existing data-gathering efforts expand the collection of citizenship data in the future.

Finally, I am directing the Department to strengthen its efforts, consistent with law, to obtain State administrative records concerning citizenship.

Fourth, it may be open to States to design State and local legislative districts based on the population of voter-eligible citizens. In Evenwel v. Abbott, 136 S. Ct. 1120 (2016), the Supreme Court left open the question whether “States may draw districts to equalize voter-eligible population rather than total population.” Some States, such as Texas, have argued that “jurisdictions may, consistent with the Equal Protection Clause, design districts using any population baseline — including total population and voter-eligible population — so long as the choice is rational and not invidiously discriminatory”. Some courts, based on Supreme Court precedent, have agreed that State districting plans may exclude individuals who are ineligible to vote. Whether that approach is permissible will be resolved when a State actually proposes a districting plan based on the voter-eligible population. But because eligibility to vote depends in part on citizenship, States could more effectively exercise this option with a more accurate and complete count of the citizen population.

The Department has said that if the officers or public bodies having initial responsibility for the legislative districting in each State indicate a need for tabulations of citizenship data, the Census Bureau will make a design change to make such information available. I understand that some State officials are interested in such data for districting purposes. This order will assist the Department in securing the most accurate and complete citizenship data so that it can respond to such requests from the States.
