I titled my blog "System Addict Abuse" because my ex-wife used the legal court system to an unfair advantage against me. It boiled down to systematic abuse. In other words she became an addict of a system that she knew would be in her favor before the divorce process was ever initiated. Her actions worked to a charm and never once did she receive a consequence for violating multiple court orders.
Here are a few other details that I had to deal with during my trials and tribulations of dealing with the court system. My ex-wife and her attorney filed a motion and a Superior court judge in New Jersey signed it declaring that I could only communicate with my then four-year old son on his own personal cell phone.
I had to pay for half the cost of the cell phone plus the monthly service fees. This was added onto the $360 per week ($1,442 per month) that was already being garnished out of my paychecks for child support. Previous to that I had called my son twice a week without fail at his daycare center. I never called him at home. It was a good thing I didn't send my son a text message because at that age he couldn't read. He wouldn't have been able to retrieve the message anyway.
Picture my son at the top of a sliding board and holding up the process of the other little kids on the playground because he's scrambling trying to answer his cell phone. Adults lose their cell phones on a regular basis.
Can you imagine a four-year old child being court ordered to carry around a cell phone so he can talk to his own father??? Better still can you imagine a Superior court judge signing such a ridiculous court order???
Then to make matters worse, my ex-wife never answered that cell phone. I didn't speak to my son for the next four months. I had to pay my own attorney more legal fees to file another motion to get that first court order overturned. It was another waste of money that could have been used for my son's future college education.
This was ludicrous!!!!! It was also a TRAVESTY of JUSTICE.
This is one of the many reasons why I feel like the state of New Jersey has little or no right to condemn the Brazilian government in the David/Sean Goldman custody case when they treat African American fathers like myself within their own system and jurisdiction much worse. There was a very skewed definition of so called litigant's or father's rights.
For those of you unfamiliar with the David Goldman story, it will air on television this Friday evening January 8th on Dateline NBC.
I guarantee that my personal story and dilemma is all factual and true. My divorce and subsequent custody case file is all a matter of public documented records within the New Jersey court system. (to be continued)
