Systematic Abuse (495 hits)


My child support saga with the Judges and the Union County, New Jersey court system still continues. Just in case anyone is curious as to the name of the Superior Court Judge who has been causing me so much grief. I'll identify her in my next Blog. She needs to be held accountable for her decisions. Here's an update on my case.

On Monday May 23, 2011, I received a child support worksheet in the mail of the numbers that were used in my calculation on April 23, 2001. Mind you that I had never seen this worksheet before. I had provided proof of my income on three separate and distinct occasions to this Judge in 2001. My paystubs from work clearly showed my monthly income as $3,000 per month, and $36,000 per year. But this judge input my income as $51,688 per year in order to calculate my child support. Even after I pleaded with her to correct this because of her errors she flatly refused.

As a Superior Court Judge she was sworn to base ALL of her decisions on the evidence presented in court. She also understated the yearly income for my ex-wife. I had every reason to question her as to the reason she was initiating my child support obligation at $285 per week. This is a clear cut case of discrimination. Let me remind you she is the same Judge who presided over the divorce case and then set the child support obligation for former New Jersey Governor James McGreevey at $250 per week on August 8, 2008.

and input the exact same numbers that this Judge used to calculate my child support on April 23, 2001. Their own online calculator verified that my child support should have been set at $139 per week based on the (incorrect) numbers that this Judge used. It would have been about $108 per week if she had used the correct income numbers. UNBELIEVABLE !!!!!!! This is a TRAVESTY of JUSTICE.

Then she threatened to raise my weekly support to over $310 per week right then and there, because I questioned the accuracy of her calculation of $285 per week. The Judge's exact words were, "If you care to argue about this, I'll immediatley raise it to $310 immediately. Now Mr. Morris would you like to argue?" This was a blatant violation of the Canons of Judicial Conduct, Canons 1, 2, and 3.

As a result of this Judge's decision, some weeks I have paid more than three times the child support that I was legally required. So after 10 long years, I continue to fight the Union County Court system to recoup the exorbitant amount of money that I was fraudently Ordered to pay by the state of New Jersey.

I've always been a history buff. I was a History major in college before I switched over and graduated with a degree in business. During the American Revolutionary War, there was a now famous American sea captain named John Paul Jones. His ship was battered, crippled and badly damaged by the British during an engagement at sea. The British captain asked if he was prepared to surrender. The reply from John Paul Jones was, "I have not yet begun to fight!"

These are the reasons after an eight year legal court battle, I was finally able to gain custody of our son Justin. I wrote a book about this case titled: "Justin: A Father's Fight for His Son". www.abemorris.com It was published in September 2009. Now I'm at a 10 year battle and will continue to strive to get the child support money back that the Union Vicinage Family Court Division unjustly garnished from my wages and intercepted two of my IRS income tax refunds ($2,699 in October 2004 and $5,710 in December 2010) and sent to my ex-wife who now resides in another state on the East coast. Prior to this IRS intercept she already owed me over $16,000 for child support arrears that she still refuses to pay. She is in contempt of court. This was pursuant to a court Order effective September 1, 2008.

I hope that I'll inspire other fathers and minorities to NEVER EVER give up. What has happened to me over a 10 year period in the state of New Jersey constitutes felony Official Misconduct. According to N.J.S.A 2C: 30-2 and N.J.S.A. 2C 30-6 this constitutes official deprivation of my civil rights based on race, color, gender and ethnicty. I am entitled to a massive reimbursement from the state of New Jersey for false and fraudalent Orders being imposed against me. To be continued ..............
