Bill Cosby urges sanctions in s*x assault case (1241 hits)


Actor and comedian Bill Cosby has filed for court sanctions against a woman who accused him of s*xual assault in 2005, claiming she leaked a deposition transcript to a newspaper. 

Andrea Constand sued Mr Cosby but settled for an undisclosed sum. 

Excerpts from his testimony appeared in the New York Times on Saturday, which detailed how he pursued women.

Mr Cosby, 78, is facing a series of s*xual assault accusations dating back to the 1970s.

He has always maintained his innocence and has never been criminally charged.

His lawyers said Ms Constand should be "sanctioned" for breaching their confidentiality agreement. 

Pay offs

Ms Constand was a former employee of Temple University - the Philadelphia college with which Mr Cosby was once closely associated.

She claimed she was tricked into taking drugs before being s*xually assaulted by the comedian. She sued after a prosecutor declined to press charges. 

All documents from the 2005 lawsuit were sealed, until a federal judge released redacted excerpts earlier this month

They contained testimony from Mr Cosby, in which he admitted under oath to obtaining a sedative, Quaaludes, to give to women he wanted to have s*x with. 

Mr Cosby also revealed he offered money to Ms Constand, and other women who had made allegations, in the form of educational trusts.

On 8 July Ms Constand applied to have the entire deposition unsealed and to break free from any confidentiality restrictions.

The New York Times later acquired its own record of the 1,000-page deposition and posted details on its website. 

But his lawyers argue Mr Cosby's admission to using Quaaludes in the 1970s does not mean he drugged and s*xually assaulted women.

"Reading the media accounts, one would conclude that defendant has admitted to rape," the filing to the District Court in Philadelphia said.

"And yet defendant admitted to nothing more than being one of the many people who introduced Quaaludes into their consensual s*x life in the 1970s."

An attempt to smear

They called Ms Constand's request to release the full details of the settlement as an "obvious attempt to smear" the performer.

She should be also be sanctioned for leaking the deposition to the New York Times through her "own hired court reporter", they added. 

"This massive breach of protocol and of the parties' settlement agreement dwarfs the petty complaints (Ms Constand) makes in her motion," the filing states.

Most of the claims of s*xual assault against the star are barred by statutes of limitations. They restrict the length of time in which legal actions can be taken after an alleged crime has been committed.

The accusations, which Mr Cosby has described as "fantastical" and "uncorroborated", have led to some of his stand-up shows being called off and the cancellation of some TV projects.

You guys aren't serious. It was the Cos' lawyer that goofed for saying ALL the women's stories had been discredited; therefore, violating the terms of the settlement making it right for Constand to now speak her peace. Please get all the facts about why the judge allowed the deposition released... This is no smear campaign but an attempt on the Cos' lawyers strategy to make it look like Constand is something other than what she is... A no nonsense woman that doesn't play games. Lol

PHILADELPHIA—Cosby’s first accuser has asked a judge to release the comedian’s full deposition in her s*x-assault lawsuit, saying that Cosby, his lawyers and agents broke the confidentiality agreement that sealed the 2006 court settlement.
Andrea Constand’s lawyer argued in a sanctions motion Wednesday that the entire deposition should be made public, including questions Cosby answered under oath about his use of quaaludes and other drugs, his alleged use of hush money to silence women, his deal to have an accuser’s story spiked and his alleged affairs with other women.
Her lawyer said Cosby and his representatives broke the confidentiality agreement with public comments made over the years and again this week, but Constand has been powerless to respond.
“The release of these documents will assist other women who have been victimized and bring awareness to the fact that s*xual assault is not just committed with a gun or knife but is also committed by mentors who engage in exploitative behaviours,” lawyer Dolores M. Troiani wrote in asking the judge to sanction Cosby and his lawyers.
Lawyers for Cosby, 77, did not immediately return calls for comment.

The motion comes after U.S. District Judge Eduardo Robreno unsealed excerpts from Cosby’s deposition this week in response to an Associated Press request, concluding that the public had a right to see “the stark contrast” between Cosby the public moralist and the statements he made under oath about his lifestyle and conduct.
The excerpts show Cosby admitting that he obtained quaaludes in the 1970s so that he could give them to young women he pursued for extramarital s*x. Asked if they knew what they were taking, his lawyers objected and he never answered.

Frustrated by their attempts to dodge questions, Troiani went to court then to force Cosby and his lawyers to co-operate in the pre-trial deposition. She asked that Robreno force the comedian to answer 50 questions about his lifestyle, drug use and s*xual encounters with 13 other “Jane Doe” women who had come forward to say Cosby had molested and perhaps drugged them years earlier.

The deposition eventually proceeded. And Troiani now wants his answers to those questions made public.
“Although some of the women engaged in consensual relations with Cosby, their accounts substantiated defendant’s alleged predilection for somnophilia,” Troiani wrote in her motion Wednesday, referring to a term used to describe someone aroused by having s*x with an unconscious person.

Cosby settled the case after his deposition for an unknown sum. Both sides agreed to keep the terms confidential and not comment on what did or didn’t happen between them.

His lawyers have not returned messages seeking comment since the release of the deposition excerpts, which they had fought. However, ABC reported that an unidentified Cosby associate, in a statement this week, said Cosby settled the suit to save accusers the embarrassment of testifying in open court. Cosby’s representatives have since said the statement didn’t come from anyone in the comedian’s camp.

Troiani, in her motion, pointed to that statement in support of her motion.

She also said that because the unsealed material does not include Cosby’s full answers, supporters could argue that the “seminal question of his admission to administering Quaaludes to s*x partners was taken out of context.”
She said making public the entire deposition and written settlement would let people decide if that’s the case.
Cosby’s statements might also be of interest to women now suing him for s*xual assault and defamation, she said.
“They have a right to determine what if anything can be used as evidence in their respective cases,” said Troiani, who sought permission this week from the Jane Doe witnesses to have Cosby’s testimony unsealed.

Cosby has never been charged with a crime and has repeatedly denied the allegations. Most of the s*xual misconduct accusations that more than a dozen women have made against him happened too long ago for criminal charges.
The AP generally doesn’t name people who say they have been s*xually assaulted unless they agree to have their names published, as Constand has done.

The Cos' machines have always slandered, discredited, and intimidated the women he's raped in order to silence them. He's used his acting skills to appear genuine and sincere when dealing w/ these ladies by offering 'carrots' that he then turned to imply the women were after money, fame, or self promotion. The guy is truly the ultimate Dr. Jekyll

@Steve.. yep... It's just uunfortunate they waited to long... So now what we see is a group of old washed up women crying about something that's happened from the 60's to the late 90's. Some of the women had long time involvement with the man!

@Jen... I'm sorry ... Disgust.. with Cos ... I'm pissed with all of these ladies whom sat in silence and took the hush money... So they just need to hush!!

Its not a matter of being gullible but rather having the evidence to convict. The only reason Constand had to settle in a civil suit was because the D.A. didn't have the sufficient evidence to bring a case although he believe what Ms. Constand accused the actor of doing. Had she immediately gone to the police, they did a rape kit and whatknot perhaps he would of being convicted and placed on a predator list.

If you go back to the comment of the D.A, he said he didn't prosecute because of insufficient evidence against the Cos.

Huth first claimed publicly last December that Cosby s*xually assaulted her in 1974 at a party at the Playboy Mansion when she was 15 years old. The Los Angeles County district attorney declined to file criminal charges, citing statute of limitations issues.
