In the past few weeks I have been in contact with attorneys, child support case workers, the media, politicians, friends and family members. Many people have told me that this is the most convoluted case they have ever heard of. I have been battling the Union County, New Jersey court system and child support division for the past 10 years. Thus the reason I call this blog "systematic abuse". In December, I even wrote a letter of complaint to President Barack Obama. I don't know if he'll ever see it. It was still worth the effort on my part. My son Justin has been living with me for almost 2 1/2 years now. I was granted primary and legal custody by a Judge in a different state where his mother had relocated.
I notified the state of New Jersey in 2008 that my son was living with me. Still, they continued to charge and add weekly child support arrears to my account. My ex-wife was court ordered to pay me child support in 2008. I never received any money from her until sometime in 2010. That put her in arrears of over $16,000 due to me just based on that court order alone. Then to add insult to injury Union County, New Jersey intercepted my IRS income tax refund for $5,710 in December 2010 and mailed the check to my ex-wife in the state where she currently resides.
This whole mess started in April 2001. A superior court Judge in Elizabeth, Union County, NJ set my child support at $285 per week. That is a total of $1,140 per month. She also told me that if I argued about it, she would raise it right then and there to about $320 per week. It's all in the court transcripts. This same Judge also presided over the divorce case of former New Jersey Governor James McGreevey. In August 2008, she set his child support at $1,075 per month for his daughter. In 2001, I was making only about $34,000 per year in salary. Child support is based on a person's salary. No one is supposed to pay more in child support than what they actually bring home. There was absolutely NO comparison to my salary and that of a former state Governor, but yet I was court ordered to pay more for child support for my one and only biological son.
