California Uphelds Gay Marriage Ban - Gay Rights Advocates Upset that "Minority Group" is Not Protected (1145 hits)

Let me ask this question before I post the text from the article. Are homos*xuals a minority? Should being black carry the same weight as being gay?

"SAN FRANCISCO — California's Supreme Court upheld the state's gay-marriage ban Tuesday but said the 18,000 same-s*x weddings that took place before the prohibition passed are still valid _ a ruling decried by gay-rights activists as a hollow victory. Demonstrators outside the court booed, wept and yelled, "Shame on you!" Activists said they would go back to the voters as early as next year in a bid to repeal the ban.

In a 6-1 decision written by Chief Justice Ron George, the court rejected arguments that the ban approved by the voters last fall was such a fundamental change in the California Constitution that it first needed the Legislature's approval.

"We are extremely pleased that the Supreme Court has acknowledged the right of voters to define marriage in the California Constitution," said Andrew P. Pugno, a lawyer for ProtectMarriage.com, the leading group behind the initiative. "The voters have decided this issue and their views should be respected."

As for the thousands of couples who tied the knot last year in the five months that gay marriage was legal in California, the court said it is well-established principle that an amendment is not retroactive unless it is clear that the voters intended it to be, and that was not the case with Proposition 8.

Moreover, the court said it would be too disruptive to apply Proposition 8 retroactively and dissolve all gay marriages.

Doing that would have the effect of "throwing property rights into disarray, destroying the legal interests and expectations of thousands of couples and their families, and potentially undermining the ability of citizens to plan their lives according to the law as it has been determined by this state's highest court," the ruling said.

While gay rights advocates accused the court of failing to protect a minority group from the will of the majority, the justices said that the state's governing framework gives voters almost unfettered ability to change the California Constitution.

The decision set off an outcry among a sea of demonstrators who had gathered in front of the San Francisco courthouse, holding signs and waving rainbow flags. Many people also held hands in a chain around an intersection in an act of protest. More than 150 protesters who blocked a street were arrested, with citations for failure to obey a police officer and jaywalking."

As a person who is such a supporter of Brown vs Board of Education, I was willing and did put my life on the line for it...I Chant(pray) that the Gay community will believe in this principal of Seprate is not legal in the country as totally as I do.

No this has nothing to do with if men and men having the right to be Gay, to have s*x that they chose as the way to be happy as I am not one to use personal emotinons to help creat law nor to out law any law. My purpose in this comment is about this land that says the ALL MEN are equal under the law /American Constution, be they a sub-minority group or African-Americanor those who goes to Trinnity churchor to sit down and eat in a cafe.

"I" do not believe that the Gays should try to get a free ride off the Africn-Americans for the gains they gained when they went to battle with our federal government over Separate is not Equal in this country!!! And, no I am not for the Gay's need to have the word MARRIAGE. I wish they would just accept Civil Union and let us all go in peace...

I repeat, my dog in this fight is for seprate in not legal, because this is what JIM CROW law is!!!!!I will never support jim crow laws as they are not limited to only Jews and Gays and Blacks do not belong in this country along side of their superior White race and if we just have to put up with them then they can not be protected like we the White peoples are...now aay can I nor will I ever support this even when it is not directly aimed at us as it is in our courts all over this country, it is the same Jim Crow laws by anyother name(smile)BEEN THERE DONE THAT...

OH, and I do not believe that this decision can, will be able to stand. A law can not be legal and be illegal at the same time. Another form of separate is equal. If the Gays can not be married in this state in May 30, 09 because it is illegal then this is giving some a legal right to be married and others can not have this right in this state?????????All citizens in America must be protected by the same law...remember thae differet sentence laws for those who did one kind of drugs(Whites and another drug (Blacks) this is seprate is equal not all must fall under the same law in America.but, Jim Crown says it is legal to give Whites shorter sentances inprison is the best way I can explain this...

This is why the Gays are trying to get a free ride off of what we accomplished in the 60s therefore they are the same legally, but not morally.This is not what I put my life on the line for and it pisses me off to no end!!!!!!!!!!!!!!!
