Legally Buy Machine Guns, Silencers, Short Barrels–Understand the NFA (882 hits)


The most common NFA Firearms are machine guns, SBRs, and silencers. It is completely legal under federal law to buy, own, and shoot these items. However, some state and local laws ban ownership so check with local law enforcement before making a purchase. In addition, prior to completing a purchase you have to first register the item in the NFA Registry with the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE or simply ATF), and pay the $200 registration tax. Fortunately the tax has not changed since 1934. (At last, something that has benefitted from inflation!)

The process is fairly simple if time consuming. As an individual, you must obtain approval from the ATF, obtain a signature from the Chief Law Enforcement Officer (CLEO) who is the county sheriff or city or town chief of police (not necessarily permission), pass an extensive background check to include submitting a photograph and fingerprints, fully register the firearm, receive ATF written permission before moving the firearm across state lines, and pay a tax. The request to transfer ownership of an NFA item is made on an ATF Form 4. (https://www.atf.gov/file/61546/download)

An alternate method of registering an NFA Firearm is as a corporation, trust, or other legal entity. When the paperwork to request transfer of an NFA item is initiated by an officer of a corporation, a signature from local law enforcement is not required, and fingerprint cards and photographs do not need to be submitted with the transfer request. Therefore, an individual who lives in a location where the chief law enforcement officer will not sign a transfer form, for example, can still own an NFA item if he or she owns a corporation or trust. This method has downsides, since it’s the corporation (and not the principal) that owns the firearm. Thus, if the corporation ever dissolves, it must transfer its NFA to the owners. This event would be considered a new transfer and would be subject to a new transfer tax.

MSNBC is leading the misinformation charge, talking about devices like this, even though the have no idea of what it is. This is not what we hear on the audio of the shooting.

Back on the range, I had a much easier time with the trigger. I’ll go back to the beginning here and talk about speed. The 3MR is as fast as you are. You do have to pull the trigger for each round to fire. But in the third mode, the 3MR flies. The reset is incredibly short. It is predictable, crisp, and it allows for a fluttering of the trigger finger that will flat out empty a magazine. Still, if you intend to fire 30 rounds, you will have to twitch the trigger 30 times.

That is a good question Steve. I don't understand the mind of a domestic terrorist.

Can you imagine if The gunman, identified by police as Stephen Paddock, who was a licensed pilot, had a silencer on those weapons? How many more dead Americans their would be, just because the people did not hear the gun shots, WOW?

Will this event, drive up the slump in gun sales?

So far, I have heard nothing from the NRA.

No. 1. Nothing will change.

We didn’t change anything after a classroom full of dead first graders. Or a theater full of dead movie goers. Or a nightclub filled with dead party goers. And we won’t change anything after a killing field full of dead country music fans.

The NRA will wrap itself in the Second Amendment and assure us that guns aren’t the problem. This, even as the sound of machine gun fire echos in our ears. It is, apparently, our God-given right to own an arsenal capable of capable of turning a concert field into a killing field.

Is it to early to talk about what happen? Or will some will say, Their you go again Ron.

He killed 58 and wounded 515. He sprayed the whole area, 22,000 people couldn't have gotten out any faster, whether they started running a few seconds earlier or not. Doesn't matter if they heard shots and ran or saw bodies dropping and ran. The shooter fired until he was out of ammunition.

If Paddock had a suppressor or didn't have a suppressor (it could have been either, we don't yet) it didn't make a damn bit of difference. Watch the video I posted above,if you haven't, of a full auto M16 with suppressor and you'll hear that it makes no difference. What I'm saying is that you and Hillary will have way more than enough excuse to be outraged, when it comes out that his M16(s) were entirely legal. The lights are slowly going on in the media, at least Fox, and fairly soon they will push law enforcement to reveal what law enforcement already knows. Might even happen today.

Subsonic .223 brings the performance of the gun to the level of a .22 LR. Because of that it can be shot without a suppressor or other hearing protection. But the reduced power is far less than what's required to cycle the action.

THE ROLE OF SUPPRESSORS
Suppressors, also known as silencers, are the hearing protection of the 21st century sportsman. Despite common misconceptions, suppressors are not silent. They are simply mufflers for firearms, which function by trapping the expanding gasses at the muzzle and allowing them to slowly cool.
SUPPRESSOR LEGALITY AND OWNERSHIP
Suppressors are regulated under the National Firearms Act (NFA) of 1934, which falls under the purview of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). To legally purchase or possess a suppressor you must:
Be at least 21 years of age to purchase a suppressor from a dealer.
Be at least 18 years of age to purchase a suppressor from an individual on a Form 4 to Form 4 transfer (contingent on state laws).
Be at least 18 years of age to possess a suppressor as a beneficiary of a trust or as a member of a corporation (contingent on state laws).
Be a resident of the United States.
Be legally eligible to purchase a firearm.
Pass a BATFE background check with a typical process time of 8 to 10 months.
Pay a one time $200 Transfer Tax.
Reside in one of the 42 states that currently allows civilian ownership of suppressors.
Benefits of Suppressors
HEARING PROTECTION
Noise induced hearing loss and tinnitus are two of the most common afflictions for recreational shooters and hunters. Everyone knows that gunfire is loud, but very few people understand the repercussions that shooting can have on their hearing until it’s too late.
Suppressors reduce the noise of a gunshot by an average of 20 – 35 dB, which is roughly the same as earplugs or earmuffs. By decreasing the overall sound signature, suppressors help to preserve the hearing of recreational shooters, hunters, and hunting dogs around the world. Even the most effective suppressors, on the smallest and quietest calibers (.22 LR) reduce the peak sound level of a gunshot to between 110 – 120 dB. To put that in perspective, according to the National Institute for Occupational Safety and Health (NIOSH), that is as loud as a jackhammer (110 dB) or an ambulance siren (120 dB). For normal caliber handguns and rifles, suppressed sound levels routinely exceed 130 dB, just shy of OSHA’s “hearing safe” threshold of 140 dB.
From a hearing conservation perspective, according to Dr. William W. Clark, the current Director of the Washington University School of Medicine’s Program in Audiology and Communication Sciences, “the most serious threat to hearing comes from recreational hunting or target shooting”.1 This is in large part due to the fact that many people choose not to use traditional hearing protection devices like earplugs and earmuffs because they want to be able to hear their surroundings. Multiple studies have found that between 70 to 80% of hunters never wear earplugs or earmuffs, and nearly half of all target shooters don’t consistently wear traditional hearing protection.2,3 Thus, it should come as no surprise that for every five years of hunting, hunters become seven percent more likely to experience high frequency hearing loss.4
In a 2011 study, the Centers for Disease Control and Prevention (CDC) stated, “the only potentially effective noise control method to reduce students’ or instructors’ noise exposure from gunfire is through the use of noise suppressors that can be attached to the end of the gun barrel. However, some states do not permit civilians to use suppressors on firearms.”5 California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, and Rhode Island currently do not allow civilians to own suppressors. Even if the Hearing Protection Act or the SHARE Act become law, suppressors will still not be legal in the eight states where they are currently prohibited.
In a similar study from 2014 on noise exposure at shooting ranges, NIOSH recommended, “if feasible and legally permissible, attach noise suppressors to firearms to reduce peak sound pressure levels.”6
In March, 2017, the National Hearing Conservation Association’s Task Force on Prevention of Noise-Induced Hearing Loss from Firearm Noise stated that “using firearms equipped with suppressors” is one of “several strategies [that] can be employed to reduce the risk of acquiring NIHL and associated tinnitus from firearm noise exposure.”7
