A Commonwealth Court judge has approved a motion from eight voters and three voting rights groups to officially oppose a GOP-led audit of the 2020 election and 2021 primary.
Common Cause Pennsylvania, the League of Women Voters of Pennsylvania, Make the Road Pennsylvania and eight voters, including two Bucks County residents, will now join consolidated legal challenges raised since September by state officials like Attorney General Josh Shapiro.
The petitioners argued personal information of about 9 million voters sought in 17 subpoenas risks falling into the wrong hands and is a violation of their right to privacy in early October. The American Civil Liberties Union of Pennsylvania and attorneys from Schnader Harrison Segal & Lewis LLP announced Friday a potential decision was expected soon.
"The voters we represent have a direct interest in this case because it’s their information that will be disclosed if the subpoena stands ... Our clients are the ones who will be harmed unless the courts block the release of this data," said Reggie Shuford, executive director of the state ACLU chapter late last week.
The Republican-led Senate Intergovernmental Operations Committee on Sept. 15 held a party-line vote issuing the subpoenas to collect names, dates of birth, addresses and the last date they voted in the November 2020 general election and the May 2021 primary.
Once the information is collected, the committee will hire a third-party vendor to determine the specifics of the investigation itself, according to information on
www.paelectioninvestigation.com. Committee Chair Sen. Cris Dush, R-Jefferson, has said previously the information will be used "to cross match and verify whether or not our voter registration system has duplicate voters, dead voters, and/or illegal voters."
Dush, Senate President Pro Tempore Jake Corman and Parliamentarian Megan Martin have since been named in multiple lawsuits filed to stop the subpoenas from moving forward.
