My confusion may be coming from the president's Exective Powers and how the Bush administraton may have made this more opened ended than our politicians are willing to admit in public or at least "I" am unable to put into context in a logical manner at this time. example,

ArticleII section 3 states...

He shall from time to time give the Congress Information of the State of the Union, and recommend to their Consideration such Measures as he shall judge necessary and expedient: he may on extraordinary Occasions, convene both Houses, or either of them, and in cases of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper...
