Thurgood Marshall

Marshall described himself as a "hell raiser" as a child, and while his naturally argumentative nature may have gotten him into a certain amount of trouble, it would prove a useful trait as a lawyer.

One of Marshall's punishments for talking too much involved the U.S. Constitution.

"Instead of making us copy out stuff on the blackboard after school when we misbehaved," Marshall later recalled, "our teacher sent us down into the basement to learn parts of the Constitution. I made my way through every paragraph."

These early experiences reinforced many of the deepest convictions that including the importance of education for individual advancement, a deep respect for the legal profession, and the recognition of the bonds of family and community.

Today's Constitution is a realistic document of freedom only because of several corrective amendments. Those amendments speak to a sense of decency and fairness.

Our whole constitutional heritage rebels at the thought of giving government the power to control men's minds.

If the First Amendment means anything, it means that a state has no business telling a man, sitting alone in his house, what books he may read or what films he may watch.

THE POWERFUL, CONSTITUTIONAL words from Lion of the Constitution Supreme Court Justice Thurgood Marshall when he began his 25-year affiliation with the National Association for the Advancement of Colored People (NAACP) in 1934 by representing the organization in the law school discrimination suit ............ Murray v. Pearson.

Murray v. Pearson was a Maryland Court of Appeals decision which found "the state has undertaken the function of education in the law, but has omitted students of one race from the only adequate provision made for it, and omitted them solely because of their color."

On January 15, 1936, the court affirmed the lower court ruling which ordered the university to immediately integrate its student population.

Donald Gaines Murray sought admission to the University of Maryland School of Law on January 24, 1935, but his application was rejected on account of his race.

The rejection letter stated,

"The University of Maryland does not admit Negro students and your application is rejected."

The letter noted the university's duty under the Plessy v. Ferguson doctrine of separate but equal to assist him in studying elsewhere, even at a law school located out-of-state.

Murray appealed this rejection to the Board of Regents of the university, but was refused admittance.

At the circuit court hearing, Marshall stated that Maryland failed to provide a 'separate but equal' education for Murray as required by the Fourteenth Amendment (using the legal standard at that time).


Marshall argued in principle that "since the State of Maryland had not provided a comparable law school for blacks that Murray should be allowed to attend the white university" and stated

The ruling was appealed to Maryland's highest court, the Court of Appeals. This court, in a unanimous decision, affirmed the lower court ruling in 1936.

The decision noted the state's requirement under the Fourteenth Amendment, as it was understood at that time, to provide substantially an equal treatment in the facilities it provides from public funds.

Since Maryland chose to only provide one law school for use by students in the state, that law school had to be available to all.

The decision of the Court of Appeals was never taken to the U.S. Supreme Court, and as such the ruling was not binding outside of Maryland; the Supreme Court addressed the same issue in 1938 in Missouri ex rel. Gaines v. Canada.

In 1936, Marshall moved to New York City to work full time as legal counsel for the NAACP.

Over the following decades, Marshall argued and won a variety of cases to strike down many forms of legalized racism, helping to inspire the American Civil Rights Movement.

Marshall's first victory before the Supreme Court came in Chambers v. Florida (1940), in which he successfully defended four African American men who had been convicted of murder on the basis of confessions to the police after extended torture, and unfettered violence.

Another Supreme Court victory came in the 1944 case of Smith v. Allwright, in which the Court struck down the Democratic Party's use of "whites-only" primary election contests in the Southern States of the United States.

TODAY marks the 49th anniversary of Thurgood Marshall’s 1967 confirmation as the first African American Supreme Court Justice.

The grandson of a slave, we remember and celebrate Justice Marshall as a champion of civil rights and universal equality.

As chief counsel for the NAACP, Marshall successfully argued 29 of his 32 cases before the Supreme Court, all of which challenged the ‘separate but equal’ ruling in Plessy v. Ferguson (1896).

In the landmark 1954 case, Brown v. Board of Education of Topeka, Marshall magnificently reasoned that the separate but equal doctrine was an unconstitutional method for keeping black people “as near slavery as possible,” effectively ending segregation in America’s public schools.

When the U.S. military deployed troops to Korea in 1950, the all negro 24th Infantry Regiment was among them.

President Truman had issued an executive order to integrate the military two years earlier,

but many senior commanders simply ignored the command.

Although the 24th's history dated back to the Civil War, the segregated regiment was under-resourced,

under-trained and often sent into the most dismal situations.

A newspaper reporter from Baltimore's Afro-American first informed Thurgood Marshall that more

than 50 negro soldiers had been arrested in Korea, a number out of proportion to the average arrests

of white soldiers.

In 1951, the NAACP sent Thurgood Marshall; America's leading radical, into the war-zone to investigate;

he eventually cleared most of the soldiers' charges.

Marshall:

There were records of trials, so-called trials, in the middle of the night where the men

were sentenced to life imprisonment in hearings that lasted less than ten minutes.

They were the old well-known drumhead court-martials, done in the heat of passion and in the heat of war.

There were fifty or sixty involved. One death penalty case. I remember in particular:

the record showed that this man was charged with being absent in the presence of the enemy.

Instead of being charged with AWOL, he was charged with cowardice in the presence of the enemy.

And fortunately for him, he produced two witnesses: a major in the Medical Corps and a lieutenant

in the Nurse Corps, both of whom testified that he was in a hospital the day that he was supposed to be AWOL.

And despite their testimony, he was convicted and given life imprisonment.

Just prior to that, I was given an audience with General of the Army Douglas MacArthur

I questioned him about the continuation of segregation in the Army and he said he was working on it.

And I asked him how many years he'd been working on it, and he didn't really remember how many.

I reminded him that at the very time we were talking, the Air Force was completely integrated,

and the Navy was quite integrated, and the only group not integrated was the Army.

General of the Army Douglas MacArthur said that he didn't find the Negroes qualified,

And when he found them qualified, they would be integrated.

Interviewer:

Do you have any further impressions of General MacArthur?

Do you feel he was definitely biased or just opinionated?

Marshall:

General of the Army Douglas MacArthur was as biased as any person I've run across.

Interviewer:

In other words, he felt basically that negros were inferior?

Marshall:

Inferior. No question about it. No question about it.

I told him about all these instances. I said, "Well look, General - you've got all those guards out there

with all this spit and polish and there's not one Negro in the whole group."

General of the Army Douglas MacArthur said, "There's none qualified."

General of the Army Douglas MacArthur said, "In field battle, et cetera, et cetera, et cetera."

I said,

"Well, I just talked to a Negro yesterday, a sergeant, who has killed more people with a rifle than anybody in history. And he's not qualified?"

And General of the Army Douglas MacArthur, "No."

That's when General of the Army Douglas MacArthur said for me to go.
