guaranteeing citizenship to freed slaves ORIGINALLY from the African Continent.

Following its ratification by the necessary three-quarters of U.S. states, the 14th Amendment, guaranteeing to African Americans citizenship and all its privileges, is officially adopted into the U.S. Constitution.

Two years after the Civil War, the Reconstruction Acts of 1867 divided the South into five military districts, where new state governments, based on universal manhood suffrage, were to be established.

Thus began the period known as Radical Reconstruction, which saw the 14th Amendment, which had been passed by Congress in 1866, ratified in July 1868.

The amendment resolved pre-Civil War questions of African American citizenship by stating

that “all persons born or naturalized in the United States…are citizens of the United States

and of the state in which they reside.”

The amendment then reaffirmed the privileges and rights of all citizens, and granted all these citizens

the “equal protection of the laws.”

“No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws,”

The 14th Amendment granted citizenship to “all persons born or naturalized in the United States,” except Indians, and barred any state from depriving “any person of life, liberty, or property, without due process of law” or denying to any person “the equal protection of its laws.”

It also addressed apportionment, stipulating that blacks would be counted as whole persons. It overruled the clause in the Constitution that counted a black as three-fifths of a person.

The 14th Amendment had its limitations, however, as it did not explicitly give blacks the right to vote. This right would not be conferred until the passage of the 15th Amendment in 1870.

Reconstruction Era

The Emancipation Proclamation in 1863 freed African Americans in rebel states, and after the Civil War,

the Thirteenth Amendment emancipated all U.S. slaves wherever they were.

As a result, the mass of Southern slaves, now faced the difficulty Northern freemen had confronted

--that of a free people surrounded by many hostiles.

One freedman, Houston Hartsfield Holloway, wrote,

"For we colored people did not know how to be free and the white people

did not know how to have a free colored person about them."

Even after the Emancipation Proclamation, two more years of war, service by African American troops, and the defeat of the Confederacy, the nation was still unprepared to deal with the question of full citizenship for its newly freed population.

The Reconstruction implemented by Congress, which lasted from 1866 to 1877, was aimed at reorganizing the Southern states after the Civil War....., and defining the means by which ALL SOUTHERNERS could live
together in a nonSlave society.

During the years after the war, ..... teachers from the North and South, missionary organizations, churches and schools worked tirelessly to give the emancipated population the opportunity to learn.

Former slaves of every age took advantage of the opportunity to become literate. Grandfathers and their grandchildren sat together in classrooms seeking to obtain the tools of freedom.

After the Civil War, with the protection of the Thirteenth, Fourteenth, and Fifteenth Amendments to the Constitution and the Civil Rights Act of 1866, African Americans enjoyed a period when they were allowed to vote, actively participate in the political process, acquire the land of former owners, seek their own employment, and use public accommodations.

Thus began the Teaching by churches of the Newly Freed, Illiterate, tortured mass of Africans......

The United States Congress passed Laws....to Aid the Enforcement and Success of the14th amendment

The Enforcement Act of 1871, is an Act of the United States Congress which empowered

the President to suspend the writ of habeas corpus to combat the Ku Klux Klan (KKK)

and other white supremacy organizations.

The act was passed by the 42nd United States Congress and signed into law by President Ulysses S. Grant

on April 20, 1871.

The act was the last of three Enforcement Acts passed by the United States Congress from 1870

to 1871 during the Reconstruction Era to combat attacks upon the suffrage rights of African Americans.

The statute has been subject to only minor changes since then....

Today, the 1871 Civil Rights Act can be invoked whenever a state actor violates a federally guaranteed

right. The most common use today is to redress violations of the Fourth Amendment's protection against

unreasonable search and seizure. Such lawsuits concern false arrest and police brutality,

most notably in the Rodney King case. The Act is still used throughout the USA...recently
