Pennsylvania judge halts election certification

A Pennsylvania state court has issued an injunction blocking any potential further certification of election results in the state, pending a hearing to be held Friday.

The order from Judge Patricia McCullough comes in the case brought by Pennsylvania voters including Rep. Mike Kelly, R-Pa., in which they allege that a state law allowing for no-excuse absentee voting violated the Pennsylvania constitution, which outlines specific cases where absentee voting is allowed.

“This Court has been presented with strained legal arguments without merit and speculative accusations, unpled in the operative complaint and unsupported by evidence,” U.S. District Judge Matthew Brann wrote. “In the United States of America, this cannot justify the disenfranchisement of a single voter, let alone all the voters of its sixth most populated state. Our people, laws, and institutions demand more.”

HARRISBURG, Pa. (AP) — A Pennsylvania appeals court judge ordered state officials on Wednesday to halt any further steps toward certifying election results, a day after Gov. Tom Wolf said he had certified Democrat Joe Biden as the winner of the presidential election in Pennsylvania. Wolf’s administration quickly asked the state Supreme Court to block the ruling from taking effect, saying there was no “conceivable justification” for it.

“Since the birth of our nation nearly 250 years ago, no court has ever issued an order purporting to interfere with a state’s ascertainment of its presidential electors — until today,” the administration said in its motion.

Commonwealth Court Judge Patricia McCullough, a Republican, had issued the order and set a hearing for Friday. It wasn’t immediately clear if she intended to hold up the certification of state and local contests on the ballot or interrupt the scheduled Dec. 14 meeting of the state’s 20 electors.

Republican U.S. Rep. Mike Kelly and others filed suit Saturday to challenge approximately 2.5 million mail-in ballots that were predominantly cast by Democrats. They said the GOP-controlled state Legislature had failed to follow proper procedure when they voted last year to expand mail-in voting. The state Supreme Court has twice this month overturned Republican challenges over election issues.

The state Supreme Court has twice this month overturned Republican challenges over election issues, why do you think The State will change their call?

Steve Williams Thursday, November 26th 2020 at 10:11AM

The state Supreme Court will rule against Trump. There are 5 Democrats against 2 Republicans after all. But that is what we want because the next stop is the U.S. Supreme Court, whom we know are much more balanced.

Lets say I gave you Pennsylvania and it's 20 electoral votes and Trump has 232, do the math Steve 20 more electoral votes would only put Trump at 252 electoral votes which is well below the threshold of 270.

Steve, 252 electoral votes will not give TRUMP a second term at president of The United States. Trump is a ONE TERM PRESIDENT and you are barking up the WRONG TREE, face it, TRUMP has been FIRED by the people of The United States of American.

Pennsylvania Attorney General Josh Shapiro quickly responded on Twitter, pointing out that this does not have much impact since the results of the presidential election have already been certified and electors chosen.

I notice that Josh Shapiro and John Fetterman are always angry and demeaning. It mean they're afraid.

Steve Williams Thursday, November 26th 2020 at 4:39PM

Angry because they're powerless to stop what's coming.

Dea. Ron Gray Sr. Thursday, November 26th 2020 at 5:22PM

Let's talk about what happen. Do you understand that this will not have much impact since the results of the presidential election have already been certified and electors chosen?

Now this tactic may have worked if the race was much closer but this was a landside for Biden and not even close at all.

Steve, just drop that BULL 💩 because numbers don't LIE and they won't LIE for TRUMP because you are powerless to stop the coming of Joe Biden and Kamala Harris.

You think Governor Wolf chose the Electors? What does the law say? Show me.

Dea. Ron Gray Sr. Thursday, November 26th 2020 at 10:18PM

No Steve, I don’t think that at all.
