Republicans want to disarm the 14th Amendment (989 hits)

I'm sure we all know what the 14th amendment is (if not: All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. A law that came about from the decision in Dred Scott v. Sandford (1857), which held that blacks could not be citizens of the United States.)

Republicans have always considered themselves the patriots, the pro-traditions, etc etc. And when progressives have tried to change laws that have already been written they are the first to call upon the constitution and how the constitution is the law of the land and our four fathers this this this.. etc.

But it seems like Everything all of a sudden is wrong w/ the constitution when it comes to what the republicans wants in regards to immigration, from the Arizona issue to now the 14th amendment which was placed on the constitution in 1868.
They feel that immigrations who come to this country "illegally" and have children in this country, that child should not be identified as an US born citizen, because of their parents "mistake" . This is a SERIOUS and unpopular issue.

Now you can say whatever you want about immigrants coming here illegally, but do you feel that the 14th amendment should be changed? I absolutely disagree w/ it because not only is it OBVIOUSLY unconstitutional it would start an uproar of prejudice within this nation.
It also goes back to the fear of White Americans in fear of one day becoming the minorities of this country, and now the desperate attempt to do w/ necessary, EVEN change a 142 years amendment. But thats a different topic at hand.. IMO

Hello Ms. Omosede O.,

If I understand correctly your concern, you are talking about White America’s 14th amendment of the Constitution, am I right.

Let us suppose that Black Americans is a sovereign country on a portion of this continent that we could call our very own, would the 14th amendment of White America’s Constitution still bother you?

Tell me what you think.

Question 1: what do I mean by that statement? If children are being born here in the states, how will one know their parents are illegal immigrants? There will have to be some background checks on certain people, the majority of those targets will me latinos and even africans. (like myself) Unless they want to start equally asking people for their "documents" anytime someone gets pregnant in the hospital, that will never work. And its obviously unconstitutional if they try to change an old law. If this changes then hey maybe the 13th amendment might change since the economy is so back we might want to UN-FREE black folks and regain some economic benefits. Its a complicated situation and I feel the majority white male republicans are slowly exposing their fear of one day becoming minorities in this country.

2. How does one prove they are an American citizen in the first place?
We the laws of the land in the beginning of this countries time in regards to immigrations laws were alot less restrictive. I know millions of Europeans came to this country w/o papers and there was never an uproar of illegal immigrants. People still worked, paid their bills had children who automatically were granted citizenship under the 14th amendment. I cannot get into details of the law of the land in regards to immigration, but my only concern is the present time. Immigrants in the past coming here illegally and having children was never an issue THEN, but all of a sudden its an issue now? Why? I've seen no legitimate response from the republican side.

I'm not knocking down on the law of the land or emotions even though im sure many others are. I know this is an unpopular thing to do and alot of americans even the court system will not allow such a change period.

This has nothing to do w/ president obama. I feel it has everything to do w/ fear of the white race one day becoming the minorities and doing w/e possible to stop it, even if it cost chaos.

If youre asking if there was a black nation would the 14amendment bother me?
Yes it would. There are already black nations out there in this. A big continent called Africa and 47 countries. But that doesnt have anything to do w/ whats wrong with the law.

But if youre asking something else.. then i dont follow.

Great post Omosede:

Please keep a few factors in mind.

1. It is election season. Republicans are expert at ginning up fear to get their voters to the polls. Scaring White People is a political tactic.

2. There is no serious threat to the the 14th amendment. Just because politicians rant and rave about some issue or other that does not mean it will be going anywhere.

3. As you pointed out in your post, Immigration is a serious and unpopular issue. And the Republicans are using it sucdfessfully to drum up fear to get votes.

Fact checking their complaints shows they are totally without merit. Immigration levels are down. Crime is down. The kind of 14th amendment babies they are talking about are a statisticallly insignificant number. There whole debate is irriational and based on fear.

Will it work? It may...because they are good at stirring up fear.

the only rememdy, as I see it: Keep telling the truth.

And

EDUCATE! EDUCATE!! EDUCATE!!!

And antother point.

Remember recently how certain Republicans criticized President Obama for saying that our Constitution had a "birth defect"?

He was referring, of dourse, to its acceptance of slavery and the dehumanization of AFrican-Americans, which was written into the Constitution. It took the most brutal war in our history to eliminate that defect.

Now, these Republ;iocans can be criticized for saying the same thing--that the Constitution is somehow defective--and that our Founding Fathers Jjudgement should be supplanted by their own.

Fortunately, this won't go anywhere. It is DOA.

These fringe elements that were Democrats up until 1960s---will not DeRail The Greatest USA President,

Our Leader Baraka Hussein Obama; also a Professor of Constitutional Law......

I just posted a piece that appeared on RAchel Maddow yesterday where she continues her effort to debunk the Right Wing efforts to use bogus issues and manufactured crises to scare their voters to the polls.

The REpublicans have been using this tactic since, at least the late 1960's when they wanted to make white people afraid of Civil Rights for All Americans. Their tactics have a history--and, sad to say, it works!!!

And the reason it works is because people are poorly informed. That is why our dear friend Irma, Queen of BIA, teaches this mantra:

EDUCATE!!! EDUCATE!!! EDUCATE!!!

And I agree. The only way out of the darkness is to find the light.

I agree with Brother Rich that this is a scare tactic and that most of the people who fall for these fear tactics aren't well informed when they go vote. Fearful Americans took to the polls to reelect former President George Bush after his party scared millions of Latino and Black Evangelicals with his bogus proposed Marriage Amendment. Republicans are saying to do away with the 14th Amendment, we all need to stop them from scaring the heck out of Immigrants and the most vulnerable~~~ the children of Immigrants.

Honestly I believe that just as the Latino children took to the streets in protest over discrimination against their parents, all young people who are being directly affected by the threat of having their parents deported and their citizenship taken away should join forces, mobilize, and make your voices heard. Educate yourselves on the hot issues and know where the elected officials stand on the issues most important to you. As Brother Rich stated this is an election year and I’ll add that the Local and State elections are crucial.

Omosede, I hope you were able to watch Rachael Nd the professor Melisa that she has on a lot. tonight they were didcussing what I was trying to tell you about on how they use to use these tactics to scare people but then it was to make sure w stayed in our place and away from thE voting polls.(smile)

And, just think now today we have all of your proud younge rEsponsiable and ready and willing to help make pur country a place we can once again take such great pride in it again....YES WE CAN...YES WE SHALL...YES WE WILL...(SMILE)

Omosede, please may I ask you a few questions...I only want to dialogue, "K"?

2. HOw does one prove they are an American citizen in the first place? Maybe more to the point, how far back do you believe the average American citizen of any any color or gender or creed can actually prove they are or are not a citizen under these new guidelines of the old guide lines...Is this a can of worms that any politician or legal system wants to open up...????!!!!???!!?

right now these people are acting on emotional out burst...but the courts only will accept facts..objective facts...or maybe this will help get to my point I am trying to make...Most African-Americans who were born in the deep south were born at home with midwives and so, so many of them don't even have a birth certific...and since it was more important to work than to get more than a few years of school if even that much and because of the conditions who do you think made sure records of Blacks were recorded in the first place?!?

all I ask is that we all think and think and think about what is going on in the real world before we go for or against this as it is a can of worms that this country cannot afford to open up just to get rid of president Obama. (smile)My brother was born in Maryland, but where his birth certific was put the place burned down...his only problem is he could not go into the Army without a birth certific...what about adopted children..again, can we in this country even open up this box of worms ?!? ...Pandora's box...

I only offer something to just think on. O.K.? much lov to you. And, you keep that seeking mind of yours "I" am so proud of you Omosede.(smile)

Omosede...it is one of the main reasons why we had the Civil Rights movement (that put an end to this types of campaignings that we see right now)and it has a lot to do with those in the Teaparty calling for a return of this country back to how it was pre the 50s and 60s...back then the way to get into political office was to out racist the next racist (it was called back then)what has Sarah Palin now in the 70% approval range and now Newt Gengradge and McCain must go after her on the sly to discredic her as the best racist or fear mongral...or that expression the REPUBLICANS ARE EATING THEIR OWN...

I hope you have seen parts of when the schools in Ark. had to bring in the Federal troops, when the governor stood in front of the school to not allow blacks into the school...well this was an election ploy to prove he was the correct person they had put into office to protect Jim Crow...today it is to lock out the Mexicans, only...this is called DISCRIMINATION AS IT IS ILLEGAL TO SINGLE OUT A SPECIFIC GROUP OR RACE, ECT...

Today it is tHE Mexicans and all one has to do is to look at the state I live in Ca. which so few know has been majority Mexican for some years now...here you vote in spaniSh...here spanish is seen better than english in from Wal-Mart to our colleges...and with the Native-Americans still not being appeased by these casiCnos and still are demandint their lands back (and getting it) the majority race is between a rock and a hard place....iN THE LATE 50S AND EARLY 60 THEY TRIED TO STOP THE MOVEMENT BY BUILDING BLACKS NEW SCHOOLS IN THE SOUTH...LOL...DID NOT WORK. (SMILE)

AND LOVE YOU WILL SEE ABOUT ILLEGALS WHO WE NEED IF WE DON'T WANT TO PAY FROM$8,00 PER HEAD OF LETTUCE to allowing teh average American to know about with a Black president too top is all it is LONG PAST panic time, but the most important things is to keep us ignorant of the TRUTH ABOUT WHAT IS REALLY GOING ON IN AMERICA...

Notice the out cry to take ethnic study out of our school books...well these books are teaching things like slaves could read and write...Black and Indian women had equal rights, ect. (smile) OH AND IN THIS STATE THE POOR ARE THE ONES WHO HAVE A BETTER CHANCE TO GET INTO COLLEGE BECAUSE OF PELL GRANTS and so so many programs to earn money and scholarships, ect.THAN THE RICH DO TODAY...LOL...

Thank you so much Omosede for your answers and for you post. I do believe this issue is something we must keep on our mind and keep discussing as a whole nation openly and honestly. In my area they are even holding work shops to better be able to understand this issue.

I agree with you that this is mostly about fear of the majority becoming the minority.but, "I" also believe that every thing happens for a reason because we all do what we believe is the best thing to do at that time. some times it is going to end up on the positive side and some times on the negative side in due time. but, as long as we end up learnign something this is always a good thing. (smile)
