Legal Analysis - What Are Your Rights During A Traffic Stop?

Video surfaced last week that showed what happened at a traffic stop between a state trooper and Sandra Bland. Bland was found dead from an apparent suicide in her holding cell a few days after the incident seen on the film, and had just a few things gone differently in that video, she might still be alive.

America’s Lawyer, Mike Papantonio, discusses this with attorney Howard Nations.

Your rights during a traffic stop are only as good as the officer respecting them. Has anyone ever said whether DuBose had a license or not?

Steve Williams Saturday, August 1st 2015 at 1:51PM

DuBose has been charged with driving without a license more than 13 times between 1995 and 2009, according to court records obtained by Cincinnati’s Fox 19. He has also been charged with driving while suspended eight times from 2005 and 2011 and with failure to display a proper a proper license plate on his vehicle four times between 1995 and 2009. Dubose had more than 75 offenses charged to him over his lifetime.

Just saw the real version of the video not a recording of the screen. It is absolutely incredible that a prosecutor would call a no front plate stop "chicken ****". It is a minor misdemeanor registration violation in the State of Ohio (where I am employed also). So this prosecutor is picking and choosing which parts of the Ohio Revised Code are "chicken ****" and which aren't. Let's assume the deceased was going 50 in a 35. Is that chicken ****? Same level of crime - a MM. And yet again - we see a violator feel that it is "optional" to comply with lawful orders. This officer was respectful, direct and 100% lawful with his questioning. Not having [an operator's license] on person in Ohio is an M1 - arrest able offense. Then attempts to flee the scene with an officer next to his car. Did the officer draw and shoot quick? I would prefer to see a dash cam to review this further - but if any part of that officer was attached to that motor vehicle - then he can clearly articulate his life was in fear. This officer will pay - solely based on the current political climate in America. Sad.

That officer have been put on leave because he lied on a official document after he had executed a man without reason. If you have seen the video, the officer shot the man one time in the head and the dead man foot jammed the Excelerator. You can not find anywhere in the officers Chess camera where he was dragged.

Brother Deacon,

To relate that traffic stop to your video and subject, did Dubose act within his rights?

Dea. Ron Gray Sr. Saturday, August 1st 2015 at 7:40PM

Brother Steve,

"You got to be kiddy me right?" This video is not about Dubose. This video is about teaching a uppity young Black Woman a lesson from the police officer in the field, right to the police chief that ran that jail, and was involved in the cover up, to the coroners office which botch Sister Bland's autopsy report.. .

Steve Williams Saturday, August 1st 2015 at 8:38PM

Okay Brother Deacon, I generalized the subject, what are your rights during a traffic stop. About Sandra Bland then. The lawyer says on the video that you are free to go once the traffic stop is complete.

Dea. Ron Gray Sr. Saturday, August 1st 2015 at 9:54PM

Thank you Brother Steve, for getting back to the subject at hand. When that traffic ticket was handed to Sister Sandra Bland, he job was done, just like he did in that traffic stop of the young lady that was driving without auto Insurance.

The prove is in the first few minutes of this video.

Steve Williams Sunday, August 2nd 2015 at 8:44AM

Brother Deacon,

He never gave her the ticket, nor her license back. The traffic stop was not complete yet when he asked her to put out her cigarette.

Dea. Ron Gray Sr. Sunday, August 2nd 2015 at 9:20AM

Brother Steve,

Did you see the previous police stop before Sandra Bland's? if not take a look http://blackinamerica.com/content/282588/n... This woman was pulled over for speeding and driving without auto insurance. She was given a warning and a "HAVE A NICE DAY."

The question should be asked, was Sister Bland breaking the law when this officer first saw her before he made the U turn and ran up on her with his lights on?

Steve Williams Sunday, August 2nd 2015 at 9:24AM

Brother Deacon,

I did see the previous stop, and that driver left the scene free. Sandra Bland would also be free if she had made the right decisions.

Dea. Ron Gray Sr. Sunday, August 2nd 2015 at 9:54AM

Brother Steve,

From the start, no matter what Sandra did, their was no right decisions, when you know that the stop was on trumped up in the first place. This is a clear case of Driving While Black "DWB."

Steve Williams Sunday, August 2nd 2015 at 10:06AM

Brother Deacon,

How is it clearly a case of DWB? Cops make U turns all the time. They pull motorists over all the time. That's what the Highway Patrol does. If he had it in for her why was he giving her a warning when it was at his discretion to give her a citation?

Steve Williams Sunday, August 2nd 2015 at 10:08AM

And notice he also asked at the previous stop was she alright, when he gave that driver the warning.

Brother Steve,

When that woman from the first traffic knew stop start she was caught speeding and driving without auto insurance, Steve, she knew that she have broke the law.

When that cop first saw Sister Sandra Bland, he saw the color of her skin. When he made the U turn Sister Sandra Bland had not broken any traffic laws. If you think at this point before the cop made the U turn and he first saw her, that Sister Sandra Bland broke any laws, what are they?

I see that you want to take the heat off you by switching to another case, Brother Steve, I told you earlier that I will not let you Hy-Jack this subject without completing this one first.

Steve Williams Sunday, August 2nd 2015 at 11:29PM

Brother Deacon,

My repost about Debose was for Robert. Now how can you say why that Highway Patrol officer made a U turn? Before he did he was heading towards town. There's no reason to think he had any reason other than he was heading out of town to resume his normal patrol.

Steve Williams Monday, August 3rd 2015 at 12:12AM

Towards campus actually. You can see Brother Deacon, he had nowhere to go in that direction.

Dea. Ron Gray Sr. Monday, August 3rd 2015 at 3:32AM

Brother Steve,

I will refer you back to my last comments to what I saw happen to Sister Sandra Bland, just so I would not have to repeat myself. I will invite you back to this link for a play by play analogy of what happened to Sister Bland .
