Alleged Tapping of the Trump Campaign
The Factor began Wednesday's show with the news that House Intelligence Committee Chairman Devin Nunes says he has evidence that intelligence agencies under President Obama picked up electronic surveillance on the Trump transition team. That may well be illegal and it gives President Trump some rational for his widely-ridiculed claim that he was wiretapped in Trump Tower. Republican Congressman Peter King, a member of the Intelligence Committee, opined on the story. "This is extremely significant," he said. "It is not that the Trump people were being wiretapped, this was surveillance of foreign individuals talking to one another. There were references to conversations they may have had with President-elect Trump and people close to him, and any time an American's name comes up it is supposed to be 'masked.' But in this case reports were written that listed the names of these people and what they were doing. President Trump overplayed his hand by saying that President Obama ordered wiretapping, but he had a very legitimate case to make." The Factor added, "This is against the law, you cannot tap and disseminate information on people for whom you don't have a warrant."

The Factor asked veteran Washington reporter Bob Woodward for his take on the new surveillance allegations. "If this is true it is a gross violation," Woodward declared. "Apparently what happened is that a couple of diplomats who could legitimately be wiretapped were talking about meeting with Trump or people on his transition team, and you can learn all sorts of things from diplomats gossiping. But under the rules, you don't name the American person who is being discussed. The idea that there was intelligence value here is really thin and this could be criminal on the part of people who named Americans. There is a real problem with people in the Obama administration possibly passing around this highly classified gossip."

The investigators have accelerated their efforts in recent weeks but have found no conclusive evidence of wrongdoing, the officials said. In 2011, the Obama Administration secretly won permission from the Foreign Intelligence Surveillance Court to reverse restrictions on the National Security Agency's use of intercepted phone calls and e-mails, permitting the agency to search deliberately for Americans' communications in its massive databases. The searches take place under a surveillance program Congress authorized in 2008 under Section 702 of the Foreign Intelligence Surveillance Act. Under that law, the target must be a foreigner "reasonably believed" to be outside the United States, and the court must approve the targeting procedures in an order good for one year. But a warrant for each target would thus no longer be required. That means that communications with Americans could be picked up without a court first determining that there is probable cause that the people they were talking to were terrorists, spies or "foreign powers." The FISC also extended the length of time that the NSA is allowed to retain intercepted U.S. communications from five years to six years with an extension possible for foreign intelligence or counterintelligence purposes. Both measures were done without public debate or any specific authority from Congress.[13]

Republican congressional investigators expect a potential “smoking gun” establishing that the Obama administration spied on the Trump transition team, and possibly the president-elect himself, will be produced to the House Intelligence Committee this week, a source told Fox News.

Classified intelligence showing incidental collection of Trump team communications, purportedly seen by committee Chairman Devin Nunes, R-Calif., and described by him in vague terms at a bombshell Wednesday afternoon news conference, came from multiple sources, Capitol Hill sources told Fox News. The intelligence corroborated information about surveillance of the Trump team that was known to Nunes, sources said, even before President Trump accused his predecessor of having wiretappedhim in a series of now-infamous tweets posted on March 4.

The intelligence is said to leave no doubt the Obama administration, in its closing days, was using the cover of legitimate surveillance on foreign targets to spy on President-elect Trump, according to sources.
