Crystal Mason, 43, was on supervised release for a 2011 conviction for tax fraud when she voted. In Texas, convicted felons can't vote until they complete their full sentence, including supervised release.

After her conviction, Mason chose to forgo a jury trial and have her sentence assessed instead. State District Judge Ruben Gonzalez oversaw sentencing.

In cases such as Mason's, the state must prove beyond a reasonable doubt that the defendant was aware that she was not allowed to vote, Tarrant County prosecutor Matt Smid said.

The investigation began after a worker at the polls reported problems with Mason's ballot, said Samantha Jordan, a spokeswoman for the Tarrant County district attorney's office.

When Mason voted in 2016, her name was not on the list of registered voters. The election judge offered her the option to vote provisionally after signing an affidavit. The document lists several requirements to vote, including that the voter is not a felon or has served the full sentence.

“The affidavit was a stop sign in front of her face,” Smid said.

Smid said sentencing in such a case depends primarily on what the judge feels is deserved because there are very few cases to use as precedent. The judge had the option to sentence Mason to anywhere between two to 20 years in prison or probation.

Mason told the Fort Worth Star-Telegram that she was never told she was not eligible to vote, and she would not intentionally risk her freedom to vote.

"I inflated returns," Mason told the Star-Telegram. "I was trying to get more money back for my clients. I admitted that. I owned up to that. I took accountability for that. I would never do that again. I was happy enough to come home and see my daughter graduate. My son is about to graduate. Why would I jeopardize that? Not to vote. ... I didn't even want to go vote."

Mason’s defense attorney J. Warren St. John told the Star-Telegram an appeal has been filed in Mason’s case in order to allow her to be released on bond.

WASHINGTON — The Internal Revenue Service today warned taxpayers to be alert to unscrupulous tax return preparers touting inflated tax refunds. This scam remains on the annual list of tax scams known as the “Dirty Dozen” for 2017.

"Exercise caution when a return preparer promises an extremely large refund or one based on credits or benefits you've never been able to claim before," said IRS Commissioner John Koskinen. "If it sounds too good to be true, it probably is."

The “Dirty Dozen,” an annual list compiled by the IRS, outlines common scams that taxpayers may encounter. These schemes peak during filing season as people prepare their returns or hire others to help with their taxes.

Scams can lead to significant penalties and interest and possible criminal prosecution. The IRS Criminal Investigation Division works closely with the Department of Justice to shutdown scams and prosecute the criminals behind them.

Scam artists pose as tax preparers during tax time, luring victims by promising large federal tax refunds. They use flyers, advertisements, phony storefronts or word of mouth to attract victims. They may make presentations through community groups or churches.

Scammers frequently prey on people who do not have a filing requirement, such as those with low-income or the elderly. They also prey on non-English speakers, who may or may not have a filing requirement.

Con artists dupe people into making claims for fictitious rebates, benefits or tax credits. Or they file a false return in their client’s name, and the client never knows that a refund was paid.

Scam artists may also victimize those with a filing requirement and due a refund. They do this by promising larger refunds based on fake Social Security benefits and false claims for education credits or the Earned Income Tax Credit (EITC), among others.

Falsely Claiming Zero Wages

Filing a phony information return, such as a Form 1099 or W-2, is an illegal way to lower the amount of taxes owed. The use of self-prepared, “corrected” or otherwise bogus forms that improperly report taxable income as zero is illegal. So is an attempt to submit a statement rebutting wages and taxes reported by a third-party payer to the IRS.

Some people also attempt fraud using false Form 1099 refund claims. In some cases, individuals have made refund claims based on the bogus theory that the federal government maintains secret accounts for U.S. citizens and that taxpayers can gain access to the accounts by issuing 1099-OID forms to the IRS.

Taxpayers should resist the temptation to participate in any variations of this scheme. The IRS is aware of this scam and the courts have consistently rejected attempts to use this tax dodge. Perpetrators receive significant penalties, imprisonment or both. Simply filing this type of return may result in a $5,000 penalty.

The IRS sometimes hears about scams from victims complaining about losing their federal benefits, such as Social Security, veterans or low-income housing benefits. The loss of benefits comes as a result of false claims being filed with the IRS that provided incorrect income amounts.

Choose Tax Preparers Wisely

Honest tax preparers provide their customers a copy of the tax return they’ve prepared. Scam victims frequently are not given a copy of what was filed. Victims also report that the fraudulent refund is deposited into the scammer’s bank account. The scammers deduct a large “fee” before paying victims, a practice not used by legitimate tax preparers.

The IRS reminds taxpayers that they are legally responsible for what’s on their return even if it was prepared by someone else. Taxpayers who buy into such schemes can end up being penalized for filing false claims or receiving fraudulent refunds.

Mason, then known as Crystal Mason-Hobbs, pleaded guilty in federal court in 2011 to one count of conspiracy to defraud the United States.

According to court records, while owning and operating a tax preparation business in Everman, Mason and her then-husband, Sanford Taylor Hobbs III, inflated tax refunds claimed on behalf of clients.

She was sentenced in March 2012 by U.S. District Judge John McBryde to five years in federal prison and three years of supervised release. She also was required to pay more than $4.2 million in restitution. Her husband, from whom she is now divorced, also pleaded guilty in the case and received a similar sentence.

FORT WORTH, Texas — Sanford Taylor Hobbs, III, and his wife, Crystal La Von Mason-Hobbs, have each pleaded guilty in federal court in Fort Worth to one count of conspiracy to defraud the U.S. by impeding, impairing and obstructing the Internal Revenue Service (IRS) in determining, computing, assessing and collecting clients’ income taxes. According to the indictment filed in the case, they owned and operated CMH Enterprise, also known as CMH Tax and Notary Service, located in Everman, Texas. Today’s announcement was made by U.S. Attorney Sarah R. Saldaña of the Northern District of Texas.

Sanford Hobbs pleaded guilty this morning before U.S. District Judge John McBryde and is scheduled to be sentenced on March 16, 2012. Crystal Mason-Hobbs pleaded guilty on November 23, 2011, and is scheduled to be sentenced on March 9, 2012. They each face a maximum statutory sentence of five years in prison, a $250,000 fine and restitution.

According to the factual resume filed in the case for Mason-Hobbs, she and Sanford Hobbs prepared and filed income tax returns, for tax years 2005-2008, with Schedule C business income and expenses for businesses that did not exist, exemptions and credits for fictitious dependents, falsely claimed earned -income and education credits and various other false statements — all with the intent of fraudulently inflating the tax refunds claimed on behalf of clients taxpayers. According to Sanford Hobbs’ factual resume, he agreed to assist her in the scheme.

IRS-Criminal Investigation is in charge of the investigation. Assistant U.S. Attorney Matthew J. Gulde is prosecuting.

Crystal Mason waived her right to a jury trial, and obviously the single person passing judgement, the judge, decicded if she was smart enough to commit millions of dollars worth of tax fraud, she was smart enough to know better than to vote. Fraud involves using a lie, deception, falsehood, or dishonesty in an attempt to gain a benefit. The states and the federal governments have identified some types of fraud as criminal--typical fraud crimes are explained below. Fraud can also be a civil wrong, which means that victims can bring a civil lawsuit for money damages, to compensate them for the losses they suffered as a result of the fraud. Civil fraud does not carry the possibility of jail time or fines; criminal fraud can result in both. A particular instance of fraud can be both a criminal offense and the basis for a civil lawsuit.

There are numerous categories and types of fraud, and the types described here are not an exhaustive list.
State and Federal Laws

Both the federal government and the individual states have numerous laws that criminalize various types of frauds. Depending on the circumstances of the case, fraudulent activity can be either a state crime or a federal crime, or both. This means that person who commits an act of fraud may be in violation of both a federal and state law at the same time, and can be prosecuted for both.

Penalties

Committing any type of fraud can lead to some significant criminal penalties. Depending on the state in which you live and the crime you're charged with, fraud can be either a felony or misdemeanor offense.
Incarceration. Fraud convictions bring with them the possibility of a jail or prison sentence. Though sentences differ widely, a misdemeanor conviction can lead to up to a year in a local jail, while a felony conviction can lead to multiple years in prison. Federal charges can lead to 10 years or more in federal prison.
Probation. A court can also impose a probation sentence if you're convicted of a fraud crime. Restitution. A person convicted of fraud will have to pay money to victims, compensating them for any loss they suffered. Court orders for compensation are known as restitution. Restitution payments must be made in addition to any fines the court imposes.

Assistant State’s Attorney Fred Day said the cases all involve alleged crimes stemming from the Nov. 8, 2016 general election, and the lengthy time frame prior to charges included initial discovery of the alleged crimes by the clerk’s office, followed by the need to interview both witnesses and those eventually charged in the cases as part of the investigation.

According to Day and court records, Marcelo Villaruz, of Beach Park, was charged with perjury for allegedly misrepresenting his citizenship prior to voting. His wife, Gina Villaruz, was indicted on the same charges. Both are scheduled to be arraigned March 21, as are the other three defendants.

Yvette Yust, of Waukegan, was also charged with two counts of perjury for misrepresenting citizenship, Day said.

Day said that Janet Pokryfke, of Mundelein, was charged with voting more than once, and perjury for allegedly casting both mail-in and walk-in votes in the general election.

Finally, Marvin Hershman, of Riverwoods, was charged with two counts of voting more than once and one count of perjury, according to Day.

All of the charges faced by the defendants are class 3 felonies, carrying a potential sentence of probation or two to five years in prison upon conviction.

On August 15, 2017, Terri Lynn Rote was sentenced following her guilty plea to Election Misconduct in the First Degree, a Class D Felony. Rote was charged after she was caught voting twice in the 2016 general election.

Due to the serious nature of the offense, the State resisted the defendant's request for a deferred judgment. Over the State's resistance, Judge Robert Hanson granted the defendant a deferred judgment, allowing her conviction to be expunged following successful completion of her term of probation. Now Chris Hayes said that Rote's case "was similar to" Mason's case. THEY HAVE NO SIMILARITY WHATSOEVER. Rote was NOT a felon and was deemed mentally deficient. Why would you compare a mentally ill person to a convicted crook?
