House approves Jan. 6 commission bill


The House on Wednesday approved a measure creating an independent commission to investigate the Jan. 6 Capitol attack, with some rank-and-file Republicans even voting with Democrats in defiance of their party leaders who warned against the effort.

Ahead of the vote, House Democratic leaders argued that they had made several concessions to Republicans to reach a compromise, with House Speaker Nancy Pelosi saying GOP leaders have raised last-minute objections because they're "afraid of the truth."

Asked if House Minority Leader Kevin McCarthy and other Republicans are afraid of being subpoenaed to testify before a commission, Pelosi responded, "You have to ask them what they’re afraid of. But it sounds like they are afraid of the truth, and that’s most unfortunate. But hopefully they’ll get used to the idea that the American people want us to find the truth."

"I certainly could call for hearings in the House with a majority of members being Democrats, and full subpoena power, and the agenda being determined by Democrats -- but that’s not the path we have chosen to go," Pelosi asserted. "We wanted the American people to have the fullest confidence in the product that there is."

House Homeland Security Committee Chairman Bennie Thompson, D-Miss., who negotiated the agreement with Rep. John Katko, R-N.Y., said it was a "shock" when McCarthy, R-Calif., told reporters he hadn't seen the agreement when it was announced.

"We have letters from him responding to it, so it’s not like he hadn’t seen it," Thompson said of negotiations. "There were no issues" on McCarthy's part when he was constantly updated by Katko and staff, Thompson continued, "But I guess that's politics."

In floor remarks ahead of the vote, Katko said, "This is about facts, it's not about partisan politics. We would've not gotten to this point if it was about partisan politics."

"The American people expect us to put partisanship aside for the sake our homeland security," he added, calling the deal "reasonable," "nonpartisan" and "nearly identical" to the bill he and 31 other House Republicans introduced to establish a commission in the days after the Jan. 6 attack.

GOP Reps. Fred Upton and Peter Meijer who, like Katko, also supported Trump's impeachment, also spoke in favor of the bill.

"If we avoid confronting what happened here a few short months ago we can ensure that intimidation, coercion and violence will become a defining feature of our politics," Meijer said.

"We need the answers, not political rhetoric, which is what this bipartisan commission can provide for all of us, for our country," Upton said. "Let the truth shine in."

Senate Minority Leader Mitch McConnell, R-Ky., on Wednesday morning came out against the measure to create a panel of five Republican and five Democratic appointees, one day after telling reporters he was undecided on the plan.

"After careful consideration I’ve made the decision to oppose the House Democrats’ slanted and unbalanced proposal," he said on the floor.

On Tuesday, McCarthy called the proposal "potentially counterproductive" and "duplicative," while the office of GOP Whip Steve Scalise, R-La., who also criticized the measure, advised Republicans to oppose it.

First of all there were the non-violent MAGA crowd, accounting for about 95% of a total of around 50,000. Approximately 5% were the Q-Anon FOLKS, and about 500-1000 were the violent Q-Anon folks led by groups like the Proud Boys and Oath Keepers. Those are being prosecuted by the Justice Department. January 6 was an organic insurrection of many of the FOLKS aggrieved by the widespread fraud perpetrated on the 2020 election.

The Arizona State Senate has ordered an audit of the 2020 election results in Maricopa County. On May 5, 2021, on behalf of the Department of Justice, you unnecessarily weighed in with a letter to the President of the Arizona State Senate, Karen Fann.



You complain that “Maricopa County election records, which are required by federal law to be retained and preserved, are no longer under the ultimate control of elections officials, are not being adequately safeguarded by contractors, and are at risk of damage or loss.” Ironically, it is not the contractors who are mishandling evidence. According to Senator Fann, the independent auditors identified several concerns relating to Maricopa County’s handling, organization, and storage of ballots. It has also been widely reported that before the equipment was delivered to independent auditors, an entire “Database” directory of election information was deleted from the Election Management System Primary machine. According to Senator Fann, “this suggests that the main database for all election related data for the November 2020 General Election has been removed.”


On May 12, Senate President Fann published a letter seeking explanation of several irregularities uncovered during the early stages of the audit, including the chain of custody of the ballots has been insufficiently recorded which has resulted in “apparent omissions, inconsistencies and anomalies.”



The apparent deliberate deletion of the election management system prior to the information being transferred to the independent auditors, runs afoul of Arizona election law. That deletion happened long before the audit began.



Amazingly your May 5 letter mirrors an April 29, 2021, letter sent to the U.S. Department of Justice Civil Rights Division by three left-leaning organizations, The Brennan Center for Justice, The Leadership Conference, and Protect Democracy. Such cribbing from these Leftist groups suggests that you are more concerned with your political fellow-travelers than election integrity.



You also intimate that the independent auditor’s plan to investigate whether questionable voter registrations correspond to the purported voter might equate to voter intimidation, when in reality the very letter you sent to Senator Fann is an attempt at intimidation, with the goal of convoluting this important audit. I urge you to uphold your duty to preserve Americans’ civil rights and support this audit, which will clear the air and restore election confidence, instead of trying to meddle in it.



Unlike yourself, Congressman Andy Biggs personally visited the site of the election audit and we are confident in the integrity of the process and look forward to reviewing the results, no matter what is found. In a constitutional republic, the most important thing you can do is make sure the integrity of our election system is protected, free, transparent, and open. That is what is taking place today.



At your earliest convenience but no later than Thursday, May 20, please respond to this letter with a commitment to uphold the rule of law and allow Arizona to confirm the 2020 elections were free and fair. Thank you for your attention to this matter, please contact my chief of staff if you wish to discuss this matter further.

Arizona officials are refuting a claim from former President Donald Trump that they deleted an entire election-related database amid an ongoing audit of Maricopa County's 2020 presidential election results.

In late April, auditors began a hand recount of 2.1 million ballots in the county, home to Phoenix, where President Joe Biden won by more than 45,100 votes. State Senate Republicans say the audit, overseen by a private company called Cyber Ninjas, is aimed at ensuring the integrity of Arizona's election system – despite the fact that Maricopa County has already audited its 2020 results and found no malfeasance.

In a May 15 statement on his website, Trump said corruption has plagued the recount and that "presidential election fraud" should be "one of the biggest stories of our time."

"The entire Database of Maricopa County in Arizona has been DELETED!" the statement says. "This is illegal and the Arizona State Senate, who is leading the Forensic Audit, is up in arms."

The statement was published on a website Trump launched in early May to communicate with his followers outside social media platforms like Facebook and Twitter, where the former president has been banned since shortly after the Jan. 6 Capitol insurrection. However, links to and copies of Trump's statement have been shared thousands of times on both platforms, according to CrowdTangle, a social media insights tool.

Since it began, the audit in Maricopa County has been plagued by misinformation. Claims on social media have falsely alleged the recount uncovered tens of thousands of fraudulent votes, that lawyers for Dominion Voting Systems tried to stop the audit, and that officials found evidence of watermarked ballots, a conspiracy theory related to QAnon.

Trump's claim about a deleted database is the latest example of that misinformation. And it's equally wrong.

That claim stems from a letter written by the Arizona Senate president, who said auditors found what appeared to be deleted files on one machine in the county. But Republican officials in Maricopa County have refuted the allegations, saying no database has been deleted.

USA TODAY reached out to Trump through his website and his press office for comment and received no response.

Ben Cotton verified the database had been deleted. Whoever did it apparently didn't know the data could be recovered by a forensic expert. I notice that all the above is garbage. If you want the facts Ron, listen to the hearing held by the number one Republican in Arizona. She is a greater authority than the so-called "election officials."
