Tamir Rice shooting was 'reasonable,' two experts conclude

(CNN)—The police shooting death of a 12-year-old Cleveland boy with a pellet gun was reasonable, two experts say in reports prepared for the Cuyahoga County Prosecutor.

Tamir Rice was killed by an officer in training outside a Cleveland recreation center in November 2014. The shooting sparked controversy given Tamir's age and the fact that he had a gun that resembled a handgun but fired pellets.

Protesters have marched through Cleveland, shared their outrage on Twitter and even used a little-known section of Ohio law to directly ask a judge to issue arrest warrants. But Officer Loehmann has remained free, and a pair of outside reports released Saturday concluded that he was “reasonable” in deciding to shoot Tamir, who was carrying a replica gun that looked much like the real thing.

Mr. Deacon,

Why do you take yourself through these stressful and agonizing moments asking White people to treat us Black Americans right when God is offering you a country, a prophet and our own religion? Can you answer that for me?

You don’t believe that the things I say are going to happen, that is your problem.

Dea. Ron Gray Sr. Tuesday, October 13th 2015 at 3:19AM

You are right, I don't believe in you. You have told me that 7 out of 10 African American's that don't have a Eropean DNA in there bloodline are PHONY. You have said that the African American people is a new race of people, make by some white thugs and not by YAH / GOD but yet you want to take us to a GOD that did not make us, how foolish that sounds.

You are right false prophet, I don't believe you or that who sent you. 👿

Harry Watley Tuesday, October 13th 2015 at 6:57AM

Mr. Deacon,

I’ve never said anything to you about African American people. I am not an African American and neither are you Mr. Deacon!

This will be my last comment. I am looking for honesty and there is no honesty here!

Dea. Ron Gray Sr. Tuesday, October 13th 2015 at 8:22AM

Yes, go look for the weak because you have come to the strongest of us with the weakest of BS. Now if you have anything to add on the subject of the police being found justified in shooting a 12 year old African American boy down in cold blood, you are welcome as always. Now if you are going to try and hy-jack this blog to talk that BS, you are headed in the right direction, stage left, with your one subject, trolling act.

Feel the power in the name of Jesus to break every chain, to break every chain, to break every chain.

Good by Mr. Harry W. Watley and remember, our doors are always door open.

I really want to see the people of Cleveland hold the CPD accountable for what they're doing to Tamir Rice. They lied on this child as he lay dying on the ground and no one has taken them to task.

However, his parents also have to take some of the blame for his behavior. Why in the hell was he out in public by himself holding and pointing a B.B. gun? Where did he get the gun, and (I doubt it would have made a difference) why was the orange cap off? Why was he in the park harassing people with something that looked like a machine gun?

He probably thought it was a joke or funny, but not in today's world, people are on edge...

Dea. Ron Gray Sr. Tuesday, October 13th 2015 at 10:51PM

The police are suppose to be trained to handle themselves in a professional level. From the video that popped up clearly showed that they LIED about that encounter. What we are witnessing in the report is a professional cover-up, some reports even go as far as to say that investigators did not talk to the police involved.

Now to point out, that this kid was in the park harassing people was not seen in that video and according to the 911 call n the park harassing people call clearly said that the kid had a toy gun. I will check that and I will get back with you Sister Muhammad.

Sister Muhammad, I like to highlight this passage from the police officer who shot Tamir Rice.

Loehmann claimed that Rice grabbed the pellet gun, which he thought was an actual firearm, forcing him to shoot.

"He gave me no choice," Loehmann told another officer moments after the shooting. "He reached for the gun and there was nothing I could do."

This highlight was from SYNOPSIS OF INCIDENT

The present incident took place on November 22, 2014 at approximately 1530 hours. Cleveland Police received notification of a subject at Cudell Recreation Park (1910 West Blvd., Cleveland, OH.) allegedly brandishing a weapon at passersby in the park area outside of the recreation center. Cleveland Police Officers Frank Garmback and Timothy Loehmann responded to the scene where Officer Loehmann shot the suspect, Tamir E. Rice, in the torso. Mr. Rice sustained a fatal wound and died a short time later.

Notice where they call a 12 year old kid Mr. Rice.

Officers Garmback and Loehmann arrived on the scene at 3:30 p.m.15 Neither Officer Garmback nor Officer Loehmann made statements to investigators however surveillance video provides substantial details regarding the actual shooting incident.

When the officers arrived, Rice was sitting alone at the gazebo. The officers' police car approached from the south and drove through the park grounds to the gazebo, travelinf. at an estimated speed of approximately 19 mph before it slowed to a stop at the gazebo. 6 The police car was a fully marked patrol car; both officers were in full Cleveland Police Uniforms.

Surveillance video camera #I provides video of the incident, viewing the gazebo from the west. There are three tables in the gazebo and Rice is sitting at the northermnost table. At 3:30:13, according to time stamp on the surveillance video, Rice stands up. He takes three or four steps toward the west side of the gazebo and in the direction of the approaching police car. When Rice first stands and walks in the direction of the approaching police car, his hands appear to be out of his pockets and midway between his waist and chest. The patrol car comes into frame at 3:30:19. As the police car comes to a stop, Rice's hands drop to his waistband area. When the police car stops, Rice is standing abeam the "A" pillar and, it appears from the video, that he is in close proximity to the patrol car. Rice's hands continue to move toward his waistband, however, the video is grainy and it is unclear - from the video - whether Rice reaches for his gun. At 3:30:23, Officer Loehmann's passenger door opens. At almost the same moment, Rice begins to fall to the ground. The evidence thus suggests that this is the point at which Rice was shot. Officer Loehmann is seen getting out of the vehicle and moving rapidly around the back of the police car to a position behind the rear of the police car on the driver's side. His handgun is drawn and aimed in Rice's direction. At the same time, Officer Garmback gets out of the driver's seat and moves around the front of the police car to a position near the push bumper at the right headlight. He, too, has his pistol drawn. The officers arrive at their respective positions of cover at 3:30:32 p.m. The critical events took place in less than I 0 seconds. The officers continue to hold Rice, who is on the ground and can no longer be seen from this camera angle, at gunpoint. Officer Garmback moves around to the north side of the gazebo and appears to make a radio call.

Notice, this is not from the police reports but from surveillance video provides substantial details regarding the actual shooting incident.

Here's that investigation for your review.

Thank you for posting the link to the report. The cops involved in the shooting said Tamir looked 16-20 yrs old and looked liked he weighed around 200 lbs. Of course they knew he couldn't be no more than 12 years old, but the cops pulled up within 5 feet of a "man with a gun," and shot him within 2 SECONDS of stopping their car. The only person to start trying to save him was an FBI agent who happened to be near by.

They could have sat in the car and spoke on the speaker "PUT THE GUN DOWN" at which time Tamir would have put the toy gun down. Simple as that, and I don't even have a background in law enforcement.

Another thing I've noticed, the caller describes the clothes hes wearing, but the 911 dispatcher keeps interrupting him asking the question: Is he black or white? Yet they are quick to tell you that "All Lives Matter".

Dea. Ron Gray Sr. Tuesday, October 20th 2015 at 11:28AM

Now they want the public to believe this LIE of and investigation after the police report and the video which is in clear conflict whit one another. The police involved with the shooting is saying one thing, then this video pops up, showing the police actions. Now this investigation is trying to white-wash this action by the police was justified.

We must keep in mind, that this was a 12 year old boy.

You said it better then I ever could, Thank You Sister Muhammad.
